Can Foreigners Buy Property in Thailand?

What Can Foreigners Buy?

Condos (Freehold Ownership)

As a foreigner, you can buy a condo and have it 100% in your name.

The only rule is that foreigners together can’t own more than 49% of all the condos in the same building.

Land (Indirect Options)

Foreigners cannot own land directly under their name, but there are legal alternatives:

  • Lease the land: You can sign a 30-year lease (with options to renew) to secure land for a villa or house. This gives you long-term use but not ownership of the land. And the renewal can’t be guaranteed or enforced in court.
  • Own a house or villa on leased land: You can own the building (villa or house) on leased land, meaning you hold ownership over the structure but lease the ground it stands on.
  • Set up a Thai company (with legal help): Some foreign buyers create a Thai majority-owned company to purchase land, but this route is complex and risky if not done with proper legal advice.

Keep in mind that if you set up a company in Thailand, you must have real Thai shareholders who are actually part of the business.

Using fake shareholders (nominees) is illegal and breaking the rules can lead to losing the land.

Things to Keep in Mind

1. Work with a good lawyer

Always have a trusted lawyer review contracts, check ownership details, and guide you through the process.

They help with due diligence, review the Sales and Purchase Agreement (SPA), and make sure your rights are protected.

2. Send payments from overseas

For foreign ownership to be valid under Thai law, payments must come from an overseas bank account.

Make sure you get the right documents (like the Foreign Exchange Transaction Form, or FET form) to prove the source of funds.

3. Understand taxes and fees

Be clear on the taxes and transfer fees you will pay at the Land Office.

If you plan to resell, also check the rules on capital gains, withholding tax, and how to prepare for a smooth transfer later.

4. Check the building and project quality

Make sure the condo or villa is in good condition, with no hidden legal or structural issues.

A proper inspection can save you a lot of stress and extra costs.

5. Know your exit strategy

Ask yourself: How easy will it be to sell or rent this property later?

Understanding the local market and demand helps you make a smarter, safer investment.
